VACANCY
POST: INDEPENDENT COMPLAINTS COMMITTEE FOR THE JUDICIARY (GRADE C)

The Public Appointments Committee of the National Assembly (“The Committee”) is inviting applications from suitably qualified Malawians for the position of Independent Complaints Commissioner (“The Commissioner”) for the Judiciary established under Section 27 of the Judicial Service Administration Act (“The Act”).

Duties
The Independent Complaints Commissioner shall be responsible for the performance and exercise of the powers and functions of the Commission and the management and administration of the Independent Complaints Commission.
Reporting

The Commissioner shall perform his or her functions independent of any person or authority, but shall otherwise be accountable to Parliament.

Qualifications and Experience
Applicants must hold a minimum of a Bachelor’s Degree in Law obtained from an institution of higher learning accredited or

recognized by the National Council for Higher Education;

  1. Be fit and proper to exercise the functions of the office;
  2. Not have, prior to the appointment, been convicted by a competent court of a criminal offence and sentenced to a term of imprisonment without the option of a fine; and,
    1. Be, or have been, a judge of a court having unlimited jurisdiction in criminal or civil proceedings; or,
    2. Be entitled to practice as a legal practitioner or an advocate or solicitor in such a court and have been entitled so as to practice for not less than ten (10) years;
  3. Those with a Master’s Degree, considerable experience at management level and experience in conducting investigations shall have an added advantage.

Remuneration and Tenure

The successful candidate shall be appointed on a five (5) year contract, renewable for an additional term, subject to satisfactory performance and the Committee’s approval. The successful candidate shall be offered an attractive remunerative package determined by the Committee.
