A. INTRODUCTION

Project Brief
The Multi-Donor Action “Strengthening Public Financial and Economic Management (PFEM) – Tikuze Malawi” is implemented by the Deutsche Gesellschaft für Internationale Zusammenarbeit (GIZ, German Agency for International Development Cooperation) on behalf of the European Union (EU) and the German Federal Ministry for Economic Cooperation and Development (BMZ). Its overall objective is to improve Malawi’s economic governance and accountability of public resources.

Over a period of four years (May 2024 – December 2027), the Joint Action blends the support to key public financial management (PFM) reforms with the support to key anti-corruption and anti-fraud institutions. It operates across five distinct results areas: (1) Domestic Resource Mobilization, (2) Budget Execution / Expenditure Management, (3) Control and Oversight of Public Resources, (4) Investigation and Prosecution of Corruption, and (5) Asset Forfeiture Process.

Anti-Corruption Component
The positions below will directly support the Anti-Corruption Component. In Malawi PFEM Anti-Corruption project component is implemented through a partner approach, working with relevant partners to identify areas of support, providing technical advice to support changes in working processes and infrastructure and human capacity development with a cross-cutting area for automation and digitalisation support.

The primary objective of these recruitments is to strengthen the investigation and prosecution of corruption and fraud in Malawi, with an enhanced emphasis on asset recovery. The position holders will work closely with key partners, including the Anti-Corruption Bureau (ACB), the Financial Crimes Division of the Malawi High Court, as well as various Law Enforcement and oversight agencies.

The primary objective of this recruitment is to strengthen the investigation and prosecution of corruption and fraud in Malawi, with a reinforced focus on asset recovery. The role will involve close collaboration with key partners, including the Anti-Corruption Bureau (ACB), the Financial Crimes Division of the Malawi High Court, and various Law Enforcement and oversight agencies.

a) Key Responsibilities:
In this role, the job holder will be responsible for implementing initiatives aimed at enhancing the effectiveness and efficiency of Malawi’s prosecutorial institutions, as well as judicial processes and procedures, with a particular focus on asset recovery. The position entails close collaboration with the Honorable Justices of the Financial Crimes Division of the Malawi High Court.

  • Contribute to the conceptualization and implementation of measures that link prosecution-led investigations to the Rules of Court, procedural requirements, and evidence management, with emphasis on financial crimes and asset recovery.
  • In consultation with the Team Leader and line manager, engage with partner institutions and relevant agencies within your specialist field to strengthen strategic alliances and cooperation frameworks on behalf of the project.
  • Oversee knowledge management activities and the development of training opportunities and capacity-building measures within your thematic area.
  • Conduct monitoring and verification of activities and results, evaluating their impact and sustainability.
  • Lead the design and implementation of initiatives that promote adoption of innovative approaches, encourage partners to embrace change, and support institutional learning processes.
  • Prepare procurement and service contract requests, manage consultants, and ensure accurate and compliant documentation of all contractual arrangements.
  • Provide technical guidance to colleagues, facilitating knowledge sharing and the dissemination of best practices within the team.

b) Specific Tasks
The Technical Advisor will be responsible for performing the following specific tasks:

  • Provide technical coordination with relevant project stakeholders, implementing agencies, and development partners in the field of prosecutions, with a focus on financial crimes, ensuring that investigative processes are effectively linked to successful prosecutions and the recovery of assets and proceeds of crime.
  • Support and monitor the progress of project activities in close collaboration with partners and stakeholders.
  • Provide content-related and strategic guidance on public integrity awareness initiatives in the public sector, strengthening institutional capacity and fostering collaboration among key anti-corruption and fraud institutions, as well as the judiciary.
  • Identify, plan, and oversee consultancy missions, including the development of Terms of Reference, preparation of procurement documentation in compliance with GIZ regulations, and technical evaluation of bids and proposals.
  • Contribute to the organisation and technical preparation of conferences, workshops, study trips, and other project-related events.

c) Required Qualifications and Experience:

  • Hold a law degree or equivalent qualification, such as Senior or Chief State Advocate, preferably with a specialization in Criminal Law and a thorough understanding of the Malawi judicial system.
  • Possess a minimum of ten (10) years’ experience as a lawyer or police prosecutor with demonstrated expertise in preparing and presenting prosecution cases; alternatively, experience as a judge, having presided over a broad range of cases including complex financial crimes.
  • Demonstrated knowledge of asset forfeiture, asset recovery, and Proceeds of Crime legislation.
  • Familiarity with international procedures and cross-border investigations is an asset.
  • Interest in training, capacity development, and/or change management initiatives.
  • Strong understanding of the importance of inter-agency collaboration and coordination for effective information sharing.
  • Knowledge of Malawi 2063 development goals and the ability to develop sustainable, context-relevant concepts.
  • Experience working in an international or multicultural institutional setting, or professional exposure outside Malawi, is advantageous.
  • High level of commitment, team spirit, reliability, intercultural competence, and respect for diversity.
  • Excellent interpersonal and communication skills, with the ability to earn the respect of the Malawi Judiciary and members of the Bar.
  • Fluency in spoken and written English, with proven teamwork and collaborative skills.
  • Proficiency in Microsoft Office applications (MS Teams, Word, Excel, PowerPoint) is required; experience with other digital tools, including presentation and data visualization software, is considered an advantage.
