LEGAL AFFAIRS MANAGER
The Public Private Partnership Commission (The PPPC) is seeking to recruit a visionary, dynamic, self-motivated, highly innovative and suitably qualified person to fill the position of Legal Affairs Manager.
The Position
The Legal Affairs Manager shall report to the Director, Legal Contracting and Compliance and will be responsible for drafting all contractual documents and ensure they cover all instances of agreements between PPPC and other parties adequately, and that they protect the interests of PPPC and Malawi Government sufficiently. The Manager is also responsible for monitoring the implementation of the contracts and ensuring that there is compliance with the organization’s policies and procedures as well as the requirements of the Malawi law.
Key Duties and Responsibilities
- Assisting the Director in performing as the corporate Board Secretary responsible for facilitating effective compliance to corporate governance of the PPP Commission in line with the provisions of the PPP Act, Corporate Governance best practice and other legal and regulatory requirements.
- Ensure that the PPP implementation strategies developed by the Project Management Team considers the necessary legal requirements and approval processes demanded by the policy and legal framework and the standard procedures and regulations.
- The Manager will be the anchor person in relation to the contracting phase of the PPP procurement process. He/she will therefore participate in negotiation meetings and will ensure that the negotiated terms and conditions do not unduly expose the Government of Malawi through contingent liabilities
- The Manager will ensure that the PPP contracts contain specific performance indicators against which the private sector operator would be monitored. Hel she shall ensure that agreements are so structured as to oblige the private sector party to allow The PPP Commission to access relevant information including delivery of physical infrastructure based on predetermined monitoring arrangements.
- Contract Monitoring, designing mechanisms in collaboration with Ministries and Contracting Authorities, Sectoral Regulations and Private partners in order for effective monitoring of PPP contracts to ensure compliance with agreed contractual obligations.
- He/she should have the ability to think strategically, anticipate future consequences and trends and incorporate them into the organizational planning. Proven record in achieving results in a business environment to support sensitive commercial transactions.
- He/she should be capable of applying strict project management and or IT project management support systems to all transactions under his/her responsibility.
- Understanding of Government organisations is an advantage.
Required qualifications, skills and experience
- A Post graduate degree in Law.
- At least five years working experience at management level.
- A licence to practice law in Malawi.
- Be familiar with public private partnership arrangements with regard to rationale benefits and risks.
- Candidate should demonstrate familiarity with the global trends and evolution of PPPs in various sectors.
- Be team player, mature with good communication skills and committed to high standards of integrity
- Computer literate in widely used applications is critical.
- PPP certification with a recognizable institution will be an added advantage though not essential.
Remuneration
