Malawi Communications Regulatory Authority (MACRA)

1.0 INTRODUCTION
The Malawi Communications Regulatory Authority (MACRA) is a statutory body established under the Communications Act (Cap. 68:01 of the Laws of Malawi) to regulate the provision of services in the communications sector of Malawi, comprising telecommunications, posts and broadcasting. Under the Communications Act, MACRA is mandated to regulate and monitor the provision of communications services and ensure that, as far as it is practicable, reliable and affordable communications services are provided throughout Malawi and are sufficient to meet the demand for such services in accordance with the principles of transparency, certainty, market orientation, efficiency, and consumer satisfaction. The Vision of MACRA is to be a world-class regulator ensuring universal access to ICT services.

DATA COMPLIANCE OFFICER

Job Purpose and Scope:
The Data Compliance Officer shall assist the Data Compliance Manager in training and compliance in establishing and maintaining an effective compliance program to promote awareness of and compliance with data protection laws, regulations, policies and standards as spelled out by the Data Protection Act.

Duties and Responsibilities

  1. Advise the Authority on data protection laws, monitoring and ensure strict adherence to data protection standards.
  2. Ensure the Authority functions in a legal and ethical manner while meeting its data protection mandate.
  3. Develop compliance programs, review the Authority’s policies, and advise management on possible risks.
  4. Assist management in developing, maintaining, and administering all aspects of the Authority’s compliance program in line with data protection regulations.
  5. Participate in developing and implementing an effective legal compliance program on data protection.
  6. Assist managers in creating sound data protection internal controls and monitor adherence.
  7. Ensure continuous revision and development of Data Protection Authority’s policies.
  8. Audit processes, practices, and documents on data protection to identify weaknesses and proffer recommendations.
  9. Collaborate with both internal and external auditors as well as Corporate Services on all data protection concerns.
  10. Assist senior managers in setting plans for compliance violations on data protection and propose sanctions.
  11. Assist in educating and training employees on data protection regulations.

Requisite Qualifications and Experience

  1. Bachelor of Law Degree (LLB).
  2. Certification as a Data Enforcement or Protection Officer will be an added advantage.
  3. At least 3 years experience as a legal practitioner or in a compliance office.
  4. Strong knowledge of data privacy and data protection laws and regulations, and a good understanding of other major privacy frameworks and evolving legislation worldwide.
